RESTORATIVE JUSTICE DALAM KELALAIAN TINDAKAN MEDIS DI RSUD TIPE C KABUPATEN DHARMASRAYA

Abstract

The special authority given to doctors has been regulated by the state in the Law of the Republic of Indonesia. From the many legal bases related to the duties and powers of a doctor and their service facilities, it is hoped that health workers can carry out their functions and authorities properly. However, recently there have been many lawsuits filed by the public against this doctor's authority, where the failure of healing efforts by doctors sometimes causes suffering to the patient due to the negligence or carelessness of a doctor in carrying out his profession. Research Objectives: To analyze the effect of the rule of law and the implementation of restorative justice on cases of medical negligence in RSUD Type C Kab. Dharmasraya. Methods: Using a sociological-juridical approach with qualitative research interpretation methods. Result: the process of resolving criminal acts of medical negligence by way of restorative justice in the case of a baby who suffered a laceration to the head during the delivery process
