LEGAL STUDY OF THE MECHANISM OF DISMISSAL OF THE HEAD OF KINARI VILLAGE, BUKIT SUNDI DISTRICT, SOLOK REGENCY (STUDY OF DECISION NUMBER: 11/G/2020/PTUN.PDG)
Abstract
This article examines the legal mechanism behind the dismissal of the Head of Kinari Village, Bukit Sundi District, Solok Regency, as adjudicated in Decision Number: 11/G/2020/PTUN.PDG by the Padang State Administrative Court. The study aims to assess the extent to which the dismissal aligns with prevailing laws and regulations concerning village governance, administrative law principles, and the protection of village autonomy. Using a normative-empirical legal research method, this study analyzes primary legal materials (such as Law No. 6 of 2014 on Villages) and the court’s legal reasoning. The findings indicate procedural and substantive irregularities in the dismissal process, including the absence of a clear legal basis and failure to follow due process. The court’s decision affirms the importance of legal certainty, accountability, and the protection of public officials' rights within the framework of good governance. This case sets a precedent for similar disputes involving village heads and highlights the role of administrative courts in safeguarding democratic governance at the local level.
